Del Ariel al Maestro Limpio

Amanec� con ganas de naquear, digo, no que est� exento de dicha actividad y estilo al 100%, pero cuando escribo... a veces hasta yo me doy hueva del l�xico tan propio, a veces soez, grosero, pero con clase, if that exist at all.

�Hoy? Nel... pastel.
Ayer justo escrib� -por mail- algunos de los puntos buenos de mi asistencia a la 53 entrega de los Arieles en el Palacio de Bellas Artes, como el mail era para alguien importante, sin darme cuenta termin� estructurando y cuidando hasta el m�s m�nimo detalle del escrito... (supongo yo que los bullets inclu�dos fueron obra del alcohol).

Hoy querido lector, usted toma un lugar secundario, mas no inferior, por que en verdad la hueva que me cargo es m�s grande que mi ego como wannabe escriba, as� que no se fije en las faltas de ortograf�a o gramaticales, y mucho menos espere un bullet... esos ya son lujo para otra persona.

Cultura Mexicana
Est� por todos lados, y n�tese que no hablo de la cultura como legado o patrimonio hist�rico, art�stico o culinario, simplemente hablo de la herencia educativa y social que tenemos en cuanto a comportamiento. El llegar a los Arieles fue todo un goce de mezcla... pero como hoy andamos naqueando, digamos que estuvo muy ching�n, que hab�a de dulce, chicle y de manteca en cuanto a grupos y reacciones.

Empezamos por los interesados en saber qu� pasa (s�, esos que se paran a media calle para ver el accidente por simple morbo o aquellos que est�n esperando encontrarse con algo no esperado, por la simple suerte de haber pasado por ah�, en ese momento). Todos formando una valla, y digo formando por que muy respetuosamente (y para mi sorpresa), sin necesidad de barandal o balaustre la gente se comport�, pasaban y pasaban artistas rumbo a las puertas del Palacio y s�lo en una ocasi�n vi que la gente se avent� para tomarse la foto con uno de ellos, Joaqu�n Cos�o.

Mi mente pens�: �te cae que tan mal est� el cine mexicano para que nadie reconozca a ning�n actor?
Mi boca dijo: Es muy temprano, se me hace que no ha llegado la banda pesada.

Ya terminando el camino de la alfombra "roja", foto aqu�, foto acuy�... gritos de "guapo", seeee... seguramente eran para mi, ni que hubieran sido para el artista de telenovela que ven�a detr�s de nosotros, na... seguramente fue mi sonrisa lo que dispar� tanto suspiro, en fin, en su momento me detuve, gir� y analic� r�pidamente la situaci�n, el interminable vicio de querer analizar situaciones y personas... y ah� apareci� la siguiente categor�a: los whisperers.

Dif�cil de ubicar, menos f�cil el analizarlos, pero �qu� tal el escucharlos?
Son personas con una agilidad mental m�s r�pida que la del mismo Guadarrama jugando StarCraft II, o la del mismo Blasio tom�ndose una cerveza extranjera... su tono, sus decibeles, son su fortaleza... poder hablar tan bajo como para no ser notados, pero lo suficiente alto para que el o�do entrenado pueda escucharlos, con claridad... obvio sobra decir que seguramente lo hacen por pensar en voz y no a prop�sito, y debo aceptar querido p�blico que sufro de lo mismo, seguid�n... seguid�n, ser� por eso que nos detectamos tan r�pido.

�la �nica diferencia? yo hablo de geek shit con mi computadora... ellos de los dem�s, a solas. o.O
"�ya viste que trae un X?" donde X es alguna marca de esas farolonas de las cuales carezco de inter�s o informaci�n, un "�Qui�n es ese?"era la que m�s predominaba y sin fin de suposiciones cual concurso de  adivinanzas, pero hubo una que aplaud� en mi mente... "�Qu� son los Aireles?"... AI-reles... re�, gir� de nuevo y continu�. Debo aclarar que mi risa no fue por burla a la pronunciaci�n... si no por la causa de la misma, tanta farolada para un evento del cual pocos saben, pocos...

Como todo, mientras m�s te metes en algo, m�s denso se pone (para mis amigos albureros... hagan de cuenta que no dije nada), sin m�s prelude, sin m�s ni m�s... el siguiente grupo se hace notar a kms, no soy fan de analizar sus drivers o motivadores, simplemente no es mi mercado, lo fue por profesi�n, nunca por decisi�n... JAJA. Los Mirrrrreeeyes y Cheapsters Creativos, seee weeee... por que son creativos weee. La banda que en verdad se sent�a por encima de muchos por el simple hecho de estar en el evento...

Pululaban... de las coladeras se escuchaban los susurros y pl�ticas, de las l�mparas colgaban sus egos, y del techo... del techo yo me quer�a aventar por el nivel de hueva que me da esa gente. No mucho que decir para ellos, pero algo que me dio gusto fue ver lo "madurito" que me he vuelto en algunas cosas... como en el "vestir" bien cuando se debe uno de vestir as� (y que conste que normalmente mi definici�n de CUANDO no es muy parecida a la de los dem�s).

No falt� el t�pico g�ey que iba en jeans y chancla... STOP! �que yo me visto igual? s�... �que yo voy a la oficina igual? s� o peor, paso la mitad de mi vida en ese lugar, leave me and Britney alone, pero �a los Arieles? qu� pas�, hasta en los peseros hay rutas. Alguna vez apliqu� la rebeld�a... con el mismo tema, la vestimenta, pero estos aplicaban no rebeld�a, m�s bien era un wannabeismo grande, y no fue uno, varios/as. Est� bien ser diferente, me agrego a ese grupo, pero si algo he aprendido es que diferente no es lo mismo que pose, no ser� el wey que se preocupa por vestir bien, no... pero una premiaci�n es una premiaci�n, ni m�s ni menos. Oremos pues... para que las almas de estos cr�os descarriados encuentren el camino a la redenci�n. �M�s que decir? no hay, ni sus pl�ticas fueron captadas, ignored for my own sake.

Los Gremios.
Y no el de la "academia"... estos peque�os y selectos grupos que se ven, se reconocen, se procuran muy expuestamente, que los dem�s sepan que no son parte del mismo. Lo curioso de estos grupos son sus sub-clasificaciones, desde el pol�tico hasta el art�stico, desde el lameballs del director hasta el lameballs del famoso... que los vean hablando, que los vean agradeciendo, que el mundo sepa lo mucho que se quieren, "es mi amigo" dicen con una simple mirada... mientras yo, ni idea de cu�l era el artista y cu�l era el barbero, qui�n era el director o qui�n era el mesero, y esto... amado lector, que ha seguido este post hasta esta parte, que se ha chutado la bola de mentadas que he escrito, esto... nos da pie al �ltimo grupo de personas que describir� en tan ya alargado art�culo...

Los nacos que no tienen ni idea de qu� carambas pasa o pas� esa noche, quien a�n invitado, no ten�a ni idea de qui�n era quien... LOS NI IDEA, y en ese grupo, me encuentro yo. (pa criticar hay que saber criticarse JAJA)

Soy un naco seguramente por no saber ni qui�n era Ofelia Medina (hasta que la vi en escenario y record� una que otra imagen), por que se sent� enfrente de nosotros, y sin escenario para mi era cualquier otra persona, soy seguramente un iluso por no saber qui�n era Luis Estrada, a�n cuando se par� a agradecer y recibir tantos premios, y a�n as� haber pensado "Na... no se parece a Luis Estrada, he oido de �l, y ese wey no se parece a lo que me imagin�, aparte... �no es el que hace telenovelas?", a�n m�s... el grupo, mi grupo de los "ni idea", seguramente apreci� m�s el opening creativ�n que tuvo el evento, las diferencias muy notorias de la remodelaci�n del Palacio, de los nominados en la primera categor�a (animaci�n) por tener ... bueno, pues... animaci�n, y no me cabe la menor duda que soy un inculto por no re�rme de la sarta de bromas locales, del medio cinematogr�fico, y a�n as�... disfrutar la noche.

Es as� como terminamos el recuento de los da�os... muchos otros grupos faltaron, pero es tarde y al final del d�a who gives a... Igual que cuando uno cambia el Ariel por el Maestro limpio, o en otras palabras, cada qui�n como le acomode, al final es lo mismo.

De Sousa v Dept of State et al Diplomatic Immunity Whiplash

The case filed by former FSO, Sabrina De Sousa against the State Department was dismissed by United States District Judge, Beryl A. Howell on January 5, 2012. From Judge Howells opinion:

"The facts underlying this case are troubling in many ways. The plaintiff served the government and the people of the United States in the Foreign Service for a decade. During the course of her service to this country, she was accused and convicted in absentia of committing a crime in a foreign nation, not for any personal gain, but at the alleged behest of the United States government. According to her allegations, she requested the government�s assistance to counter the charges against her in Italy, but received none and was instead �[e]ffectively abandoned and left to fend for herself.� Am. Compl. at 2. Following her foreign conviction, she faces the risk of arrest and imprisonment if she travels outside the United States, which is a particular hardship in her case both because of the impact on her professional options and because she is a naturalized citizen with family members living abroad. Then, when the plaintiff sought judicial review in this Court, the government did little to minimize the �logistical obstacles� presented by the need to protect against the inadvertent disclosure of classified information, but rather denied her counsel the use of a secure computer to draft filings and �threatened� the continuation of her counsel�s security clearance. ECF No. 63 at 13 n.6. The message that this scenario sends to civilian government employees serving this country on tours of duty abroad is a potentially demoralizing one."

On diplomatic immunity, the Court notes that "the government is alleged to have undertaken an action � the non-assertion of immunity on behalf of De Sousa in a foreign judicial proceeding � that is within its discretion."

Also this:

"The plaintiff�s entitlement (or not) to diplomatic or consular immunity in the Italian proceeding is a non-justiciable foreign policy question. El-Shifa, 607 F.3d at 844 (�[C]ourts cannot reconsider the wisdom of discretionary foreign policy decisions.�). The relevant international treaties on diplomatic and consular immunity make clear that the immunities set forth in those treaties are to benefit states and not individuals. See Vienna Convention on Consular Relations, pmbl., Apr. 24, 1963, [1970] 21 U.S.T. 77, T.I.A.S. No. 6820 (hereinafter, �VCCR�) (�[T]he purpose of such privileges and immunities is not to benefit individuals but to ensure the efficient performance of functions by consular posts on behalf of their respective States.�);

Here are some facts about this case, extracted from the court filing:

• Sabrina De Sousa is a naturalized U.S. citizen born in India who served as a Foreign Service Officer for the U.S. State Department from 1998 to 2009. 
  
• In August 1998, she was assigned to the U.S. Embassy in Rome, Italy as a Political Officer, Second Secretary.
  

• In May 2001, she was transferred to the U.S. Consulate in Milan as a Vice Consular Officer for a tour of duty scheduled to end in May 2004.

• Her employer provided her with a United States government diplomatic passport that explicitly stated that she was abroad on a diplomatic assignment.

• On February 17, 2003, the plaintiff was vacationing at a ski resort in Madonna di Campiglio, Italy, approximately 130 miles from Milan, Italy.

• According to news reports, on that same day, U.S. and Italian intelligence agents kidnapped Abu Omar in Milan and, in an act of �extraordinary rendition,� transported him to Egypt, where he was interrogated and tortured.

• In January 2004, the plaintiff�s tour of duty in Italy ended and she returned to the United States, where she continued to work for the State Department.

• In July 2006, the prosecutor issued an arrest warrant for De Sousa, whom he identified as one of the four U.S. officials mainly responsible for the alleged kidnapping. The warrant against De Sousa is a EUROPOL warrant, meaning that if she attempts to enter any country in the European Union, she faces immediate arrest and transfer to Italian authorities. Countries outside the European Union could also choose to arrest and extradite her to Italy. Arrest warrants were also issued for several other alleged U.S. and Italian agents.

• Around the time that her arrest warrant was issued, the plaintiff wrote to then-Secretary of State Condoleeza Rice requesting that the U.S. government invoke diplomatic or consular immunity with respect to her alleged involvement in the kidnapping of Abu Omar and provide her with legal representation to counter the charges in the Italian criminal case. She did not receive any response.

• The plaintiff�s employer instructed the plaintiff not to communicate with her Italian government appointed defense lawyer or with the media.

• In October 2008, the plaintiff requested approval from her employer to take a vacation to visit family members in India, but the request was denied because of concern that theoutstanding EUROPOL warrant for De Sousa might lead to her arrest and extradition to Italy.

• In early 2009, the plaintiff again wrote to the Secretary of State � by then Hillary Clinton� requesting official government assistance with the Italian case, but she again did not receive a response.

• On February 13, 2009, the plaintiff resigned from her employment with the U.S. government.

• In August 2009, approximately three months after the plaintiff�s filing of this action in May 2009, the U.S. government agreed to provide the plaintiff with defense counsel in Italy.

The last time diplomatic immunity was big news was when Raymond Davis was arrested in Pakistan and the USG contended that he was protected by diplomatic immunity because of his employment with the U.S. Consulate in Lahore.  He was later reported to be a private security contractor for one of the agencies that must not be named.

This case involves a Foreign Service Officer who held a diplomatic passport at the time of the alleged crime. And from the looks of it, the State Department and the U.S. Government gave her the finger instead of lifting one to help her.  Granted that the allegation of �extraordinary rendition" has such a nasty ring to it .... the governments handling of this case is more than "potentially demoralizing."  How would you like to be in her shoes?  The next time the State Department talks about leadership and "taking care of the troops," somebody please ask nicely about this one.
